That's a poor question unless there are legal experts available to respond. Copyright law is ambiguous even to lawyers, and with the decades-long, multimillion-dollar public campaigns against everything from used CD stores to home taping a layman's perspective is too-often bound up in propaganda and misinformation rather than being an accurate reflection of the state of the law. It would be better to shift the focus of discussion from what is perceived as "legal" or "illegal" to simply what should be forbidden and allowed on this site. Should it be allowable to post a link here which circumvents the DAS.com system as it is established now? The best solution would probably be to contact the band and ask them what they think about it; but given the explicit request accompanying "Clock Radio" not to exploit the content and to take it in the form in which it was intended to be given, I would assume the same philosophy applies to DAS, and that the answer would be "no".
It might also be a good idea to get positive confirmation of the band's approval of the lyrics and tabs indexed on this site. It could be argued (and has been) that lyrics in liner notes accompanying a physical CD are added-value which promotes commerce, and that listing such content for free may divert a revenue stream. As for tabs, given the upcoming TMBG Songbook it would probably be a good idea to get approval before it becomes an issue. A lot of people may resist this idea, but it derives from a logical extrapolation of the principle of information ownership. Does anyone have a reliable official contact through which these matters could be clarified?

TMBG knows of this website and has even linked to it in an official newsletter, so if they didn't want lyrics or tabs on here, they'd be long gone by now. Once the songbook is released, we most likely will remove the tabs for songs included in the book. As for the DAS mp3s, the links have been removed. Posting links to normally inaccessible mp3s goes directly against the Clock Radio disclaimer, which doesn't only apply to the CR. -CapitalQtalk ♪ 11:31, 11 Mar 2006 (CST)
This sort of response is why I specified "positive confirmation". I know it's tough to consider given that the lyrics are a large part of the appeal of the site, but regardless: what you're going on is an assumption. It's a fallacy to equate a mention of the site in the newsletter, or lack of legal action, to approval of the contents of the site. It really would be best to obtain explicit approval. Why leave it ambiguous, especially if there is confidence in the band's endorsement?
However, in an interview (I'm prety sure it was the one with KEXP), Johns acknowledged that techies would probably take the songs on the Dial-A-Song site and turn it into a 24 hour TMBG playlist. Just saying. -AtionSong 11:56, 11 Mar 2006 (CST)
We're talking about lyrics and tabs now, not mp3s. And just because a John acknowledges the fact that the mp3s can be stolen doesn't make it right to do. It's easy enough to just hit the target until you've gotten every song on the list. And every website ever has lyrics and tabs on it and I've never heard of one getting in legal trouble, so who cares? - extrafacelol.
Actually, some of those lyrics sites out of the many thosands have had legal problems and actually need to get express permission from the copywrite holders in order to post the lyrics on their site. Its utter madness. However I have a feeling that the johns are supportive of tmbg fan sties such as this one ~ Anklepants

New Songs[edit]

Maybe I'm just missing something really obvious here, but I've been checking out the new dialasong.com, and I can't find or hear the new songs mentioned in today's current events--Cast Your Pod To The Wind, La Dolce, Podcast Remix, and "various other music from the Podcast." Can anyone help me here? ~Drew

Well, obviously i must be, because i rebooted my computer, and then it worked fine. Weird. One thing though, is that I can't get the "download" function to work within the player. It gives me a 404: (http://www.dialasong.com/song1/undefined). I sent a note to info@dialasong.com, in hopes that they can fix it. --Duke33 13:21, 3 August 2006 (UTC)
Oh, wow, I never even noticed that download function until you mentioned it and then I tried it out! (Yeah, the site doesn't seem too user-friendly/easy to use, but it's free, so we can't really complain!) But yeah, I get a 404 too when I try to download songs. :( Anyone out there having better luck? ~Drew
When I first found the site, La Dolce wasn't working for me. The window would open but nothing would play. It seems to have fixed itself though because I haven't done anything at all (not even close the "info" page's tab in the browser) and it now works, so I wouldn't be too worried. No, they're supposed to be downloadable. After you click "Click Here To Play" (for some reason I have to click it twice every time), if you click on the "TMBG" link at the bottom right of the window, a link appears that says "download mp3." (Like I said, it's not very obvious, not very user-friendly.) But when you click on "download mp3," you get a 404 "The page cannot be found" page instead of the MP3. For example, for song 2, the page that comes up with a 404 is http://www.dialasong.com/song2/undefined (just like the example Duke33 gave above for song 1). And since it's Flash, there are no other options like right clicking that I know of. Does anyone else have any ideas? If not, we'll just have to hope that the e-mail Duke33 sent to info@dialasong.com helps. ~Drew

Yes, I noticed that it appears that way as well... if you visit the site via the tmbw download page. Then, for some reason, the "TMBG" link isn't a link. But if you go there by clicking the picture on dialasong.com the link will be there, but the download link still doesn't work. It's a conspiracy I tell you. Also: I'd bet that Tehbagel simply thought you were correcting it instead of updating it, just a good ol' misunderstanding. --badqueso 07:23, 5 August 2006 (UTC)
